1. ACCEPTANCE OF TERMS

2. DESCRIPTION OF SERVICE

Before the Dates is an automated messaging and gifting service that helps users schedule personalized messages and optional gifts for special occasions including birthdays, anniversaries, graduations, holidays, and other important dates.

3. SMS MESSAGING TERMS

3.1 SMS Program Consent

By providing your mobile phone number and opting into our SMS messaging program, you expressly consent to receive automated text messages from Before the Dates. This includes:

• Reminders about upcoming scheduled messages
• Account notifications and updates
• Service announcements
• Promotional messages about our services

3.2 Third-Party Recipients & Consent Requirements

IMPORTANT: When you enter mobile phone numbers for recipients (friends, family members, or other third parties) into our Service, you represent and warrant that:

• You have obtained prior express written consent from each recipient to receive messages on their behalf
• Each recipient has agreed to receive automated text messages related to the occasions you have scheduled
• You are authorized to act on behalf of each recipient for the purpose of scheduling messages
• You understand that you are fully responsible for ensuring compliance with all applicable laws regarding consent for each recipient’s phone number

You acknowledge that:

• It is your legal obligation to obtain proper consent before entering any third party’s phone number
• Failure to obtain proper consent may result in legal liability for TCPA violations
• You will indemnify Before the Dates against any claims arising from your failure to obtain proper recipient consent
• You must inform recipients that they can opt out by replying “STOP” to any message

Consent Documentation: You agree to maintain records of consent obtained from all recipients and provide such documentation to Before the Dates upon request.

3.3 Message Frequency & Content

• Message frequency varies based on your scheduled events and account activity
• You may receive up to 10 messages per month
• Messages may include reminders, confirmations, promotional content, and service updates

3.4 Opt-Out Instructions

You may opt out of SMS messages at any time by:

• Replying “STOP” to any text message from us

• Logging into your account and updating your communication preferences

After opting out, you will receive one final confirmation message. You may also opt back in by texting “START” or updating your account preferences.
